Reviews and appeals
If you are dissatisfied with a QCT decision that concerns you, you may apply for an internal review by the Internal Review Committee (IRC).
How to apply
To apply for an internal review of a decision, you must complete the Application for internal review form [PDF 89.4KB] and clearly state the grounds for your application.
Before you apply, you should familiarise yourself with the internal review process and timelines below.
28 days to apply
You must submit your application within 28 days of being notified of the decision. If no notice of the decision was issued, you have 28 days from the date you became aware of the decision.
If you are unable to meet this deadline, you may apply to the QCT for an extension of this 28-day period by contacting InternalReview@qct.edu.au with sufficient justification. The QCT will assess your justification and decide whether to accept your application after the 28-day period.
Decisions that may be reviewed
Granting registration or Permission to Teach
- If you applied for full registration but were only granted provisional registration.
- If you currently hold provisional registration and applied for full registration, but this was not granted.
- If your application for registration or Permission to Teach was not granted because you did not meet the eligibility requirements for either professional practice or suitability to teach.
Renewing
- If your full registration or Permission to Teach was not renewed because you did not meet the relevant eligibility requirements for professional practice or suitability to teach.
Conditions, suspensions, or cancellations
- If a condition of your registration or Permission to Teach was not removed.
- If your registration or Permission to Teach was suspended or cancelled because you did not comply with an imposed condition.
- If we took specific action regarding a condition on your registration or Permission to Teach, following a review.
Certification
- If your Stage 1 application for Highly Accomplished or Lead Teacher certification was not progressed to Stage 2 because it did not meet the professional standards for certification.
- If certification for Highly Accomplished or Lead Teacher was not granted because you did not meet the professional standards for certification.
- If your Highly Accomplished or Lead Teacher certification was not renewed because you no longer meet the professional standards for certification.
Other
- If a preservice teacher education program was not approved.
- If the Professional Capacity and Teacher Conduct Committee (PC&TCC) took disciplinary action against you, including:
- issuing a warning or reprimand to you
- imposing conditions on your registration or Permission to Teach
- ordering a notation or endorsement about you be entered on the register
- accepting an undertaking from you.
Review process
The IRC consists of:
- at least three persons, including a Chairperson appointed by the Board, a Board member who is a practising teacher, and a Board member who is a representative of an employing authority for a school
- a registered health practitioner who is listed on the health practitioner panel, if the review relates to either an original decision about a practice and conduct matter or a Suitability to Teach Committee matter involving an impairment of a relevant teacher
- any other person.
The IRC conducts the review on:
- the material before the QCT or the relevant committee that led to the original decision
- the reasons for the original decision
- any other relevant material the review committee allows.
The IRC must give you a reasonable opportunity to make oral or written submissions:
- Once you apply for an internal review, you will be issued a notice that provides further details on how you can make additional oral or written submissions.
- The notice will provide a clear deadline for you to provide this information to the committee.
Generally, the IRC will make the final review decision. However, if the matter concerns a College decision, then the IRC will make a recommendation to the College, and the Director (Chief Executive) will make the final review decision.
The final review decision will:
- confirm the original decision
- amend the original decision
- substitute another decision for the original decision.
A notice of the review decision will be issued to you within 60 days of your application; alternatively, the original decision stands.
External review
If you are dissatisfied with the outcome of the IRC decision, you may seek an external review through the Queensland Civil and Administrative Tribunal (QCAT).
