Practice and conduct agreements
The QCT can make a practice and conduct agreement with a teacher if minor disciplinary action is needed. However, the QCT cannot do this if they believe the teacher has a health issue (impairment) that may have caused or contributed to the behaviour.
How the agreements work:
- The QCT will tell the teacher as soon as possible if they want to create a practice and conduct agreement, and explain why.
- The QCT and the teacher must agree:
- that there is a valid reason for disciplinary action
- on the type of disciplinary action to be taken.
- The teacher must give written consent to the agreement.
The QCT and the teacher can agree to:
- take no further action
- issue a warning or reprimand
- add conditions to the teacher’s registration or Permission to Teach.
If an agreement isn't reached:
If the teacher and QCT can’t agree on the issue or the action, the matter will be sent to the Professional Capacity and Teacher Conduct Committee (PC&TCC).
Professional Capacity and Teacher Conduct Committee (PC&TCC)
The PC&TCC deals with practice and conduct matters concerning teachers.
QCAT
The Queensland Civil & Administrative Tribunal (QCAT) handles cases about teacher behaviour and conduct.
These cases are referred to QCAT by the QCT or the PC&TCC.
When QCAT looks into a teacher's conduct, the panel must include three people:
- a legally trained person who understands schools
- a registered teacher
- someone who is not a teacher
If QCAT finds a teacher has done something wrong, they can:
- take no further action
- end a suspension if the teacher’s registration was suspended
- give the teacher a warning or reprimand
- cancel the teacher’s registration or Permission to Teach
- ban the teacher from reapplying for registration or Permission to Teach for a set time
- add, change, or remove conditions on the teacher’s registration or Permission to Teach
- suspend the teacher’s registration or Permission to Teach for a certain period
- order the teacher to pay costs, such as:
- investigation costs paid by the QCT
- costs from the QCAT hearing
- fine the teacher
- add a note or endorsement about the teacher in the register
- make any other order they think is appropriate
- accept a promise (undertaking) from the teacher.
