Prosecuting authorities

The Education (Queensland College of Teachers) Act 2005 requires that a prosecuting authority must notify the QCT about a committal, conviction or other matter if the person is charged with an indictable offence and the Commissioner of Police or the Director of Public Prosecutions believes, on reasonable grounds, that the person is an approved teacher or was at the time the offence is alleged to have been committed (s.80).

An indictable offence includes an indictable offence dealt with summarily, whether or not the Criminal Code, section 659 applies to the indictable offence.
