Grounds for disciplinary action

Under the Education (Queensland College of Teacher) Act 2005 the QCT may start disciplinary proceedings against a person who is or was a registered teacher at the time of the alleged incident giving rise to grounds for disciplinary action.  Grounds for disciplinary action include circumstances in which the teacher:

• has been convicted of a serious offence or other indictable offence
• fails to comply with a condition of registration
• is incompetent in performing the work of a teacher and is dismissed or resigns from employment as a teacher in Queensland in circumstances that, in the opinion of the employer, call into question the teacher’s competency in performing the work of a teacher
• was registered in another state and their registration was suspended or cancelled
• was employed in another state that does not register teachers and their employment was terminated because the teacher’s employer was reasonably satisfied the teacher was not competent or suitable to be employed as a teacher
• did not possess or no longer possesses the qualifications and experience relied upon by the teacher to obtain registration or permission to teach
• is not suitable to teach
• fails to comply with a lawful demand made under this Act by the QCT, an investigator or a disciplinary committee.
